SUPERIOR LEAK DETECTION
Terms of Service
Effective Date: April 13, 2025
Please read these Terms of Service (‘Terms’) carefully before using the services offered by Superior Leak Detection (‘Company,’ ‘we,’ ‘us,’ or ‘our’). By accessing our website, requesting a quote, scheduling a service, or engaging our company in any capacity, you (‘Customer,’ ‘you,’ or ‘your’) agree to be bound by these Terms.
1. Services
Superior Leak Detection provides professional leak detection and leak repair services for residential and commercial properties, including but not limited to:
• Pool and spa leak detection
• Irrigation and plumbing system leak detection
• Leak repair services as applicable
All services are provided in accordance with applicable state and local laws in Texas. We reserve the right to decline any service request at our sole discretion.
2. Service Agreements & Estimates
All estimates provided by Superior Leak Detection are non-binding unless confirmed in writing via a signed service agreement or work order. Estimates are based on information available at the time of assessment and may be subject to change upon further inspection.
Any additional work identified during service delivery will be communicated to the Customer prior to proceeding. Authorization from the Customer is required before additional work is performed, except in cases where immediate action is necessary to prevent property damage or safety hazards.
3. Customer Responsibilities
By engaging our services, you agree to:
• Provide accurate and complete information regarding the property and the nature of the suspected leak or issue.
• Ensure safe and reasonable access to all areas of the property necessary for service delivery.
• Notify us of any known hazards, underground utilities, or special conditions on the property.
• Be present or designate an authorized representative during service, unless otherwise agreed.
• Secure pets and ensure the work area is clear before our team arrives.
4. Payment Terms
Payment is due in full upon completion of services unless a written payment arrangement has been agreed upon in advance. We accept cash, check, and major credit cards. Returned checks are subject to a returned check fee in accordance with Texas law.
Unpaid balances past 30 days may be subject to interest charges at the maximum rate permitted by Texas law. Customer agrees to reimburse Superior Leak Detection for all reasonable costs of collection, including attorney’s fees, for overdue accounts.
5. Warranties & Limitations
Superior Leak Detection warrants that all services will be performed in a professional and workmanlike manner. Any warranty on specific repair work will be stated in writing on your service agreement or invoice.
We do not warrant that our services will detect every leak or defect in a system. Leak detection is a diagnostic service, and results may be limited by soil conditions, pipe materials, access restrictions, or other factors beyond our control.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPERIOR LEAK DETECTION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE USE OF OUR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
6. Property Damage
While we take every reasonable precaution to protect your property, certain leak detection and repair methods may require excavation, drilling, or other intrusive procedures. We will notify you in advance of any such procedures and obtain your authorization. Superior Leak Detection is not responsible for pre-existing damage or conditions discovered during service.
Any damage directly caused by our negligence will be addressed in accordance with our insurance coverage and applicable law. We carry general liability insurance as required by the State of Texas.
7. Cancellations & Rescheduling
We ask that you provide at least 24 hours’ notice if you need to cancel or reschedule an appointment. Failure to provide adequate notice or failure to be present at the scheduled appointment time may result in a service call fee.
Superior Leak Detection reserves the right to reschedule appointments due to weather, equipment issues, or other unforeseen circumstances. We will make reasonable efforts to notify you promptly of any changes.
8. Privacy
We collect and use personal information you provide (name, address, phone number, email) solely for the purpose of delivering our services, communicating with you, and processing payments. We do not sell or share your personal information with third parties for marketing purposes.
By engaging our services, you consent to receive communications from us related to your service, scheduling, invoices, and follow-up. You may opt out of non-essential communications at any time by contacting us directly.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be resolved in the appropriate courts of Houston County, Texas.
In the event of a dispute, both parties agree to first attempt resolution in good faith through direct communication before pursuing formal legal action.
10. Modifications to Terms
Superior Leak Detection reserves the right to update or modify these Terms at any time. Updated Terms will be posted on our website and will take effect upon posting. Your continued use of our services after any changes constitutes your acceptance of the revised Terms.
11. SMS / Text Message Communications
Consent to Receive Text Messages
By providing your mobile phone number to Superior Leak Detection and opting in to receive text messages — whether via our website, a form submission, a verbal agreement with a representative, or any other means — you expressly consent to receive SMS and MMS text messages from Superior Leak Detection. These messages may include appointment confirmations, scheduling reminders, service updates, estimate follow-ups, and other communications related to your service requests.
Message Frequency & Content
Message frequency varies depending on your service activity. You may receive messages related to scheduling, appointment reminders, job status updates, estimates, invoices, and customer satisfaction follow-ups. We do not send unsolicited promotional or marketing text messages without your prior consent.
Message & Data Rates
Message and data rates may apply. You are responsible for any charges imposed by your mobile carrier for sending or receiving text messages. Superior Leak Detection is not responsible for any fees charged by your carrier.
How to Opt Out
You may opt out of receiving text messages from Superior Leak Detection at any time by replying STOP to any text message you receive from us. After opting out, you will receive a one-time confirmation message and no further text messages will be sent to that number, except as required by law. To re-enroll, reply START or contact us directly.
How to Get Help
If you need assistance, reply HELP to any text message from us or contact us directly using the information in Section 12 below. We will respond promptly to any help requests.
No Consent Required for Service
Consent to receive text messages is not a condition of purchasing or receiving any service from Superior Leak Detection. You may decline to provide consent without affecting your eligibility for our services.
